She spoke about this on the "Znai.ua" channel.
The journalist notes that many people are asking what to do when encountering the TCC, how to act, and what their powers are. According to her, if you are traveling by car, the only legal basis for a stop can be article 35 of the law "On National Police," not article 32, as is often claimed. By the way, the journalist reminds us that mobile checkpoints are not provided for by law.
“Only the police can detain you; the TCC does not have that right. All these videos of their busification are illegal. If you are asked to go somewhere or to travel, you can confidently refuse. Remember – article 17 of the Constitution states that the Armed Forces of Ukraine or other military formations are prohibited from being used to restrict the rights and freedoms of citizens. However, this article also imposes an obligation that citizens must defend Ukraine. So please keep in mind your rights and do not forget your responsibilities,” explains Yekaterina Kotenko.
Thus, the journalist states that if you do not want to go anywhere, you should draw up a protocol for administrative detention, and you also have the right to demand free legal assistance. Moreover, to be mobilized, she reminds, one must undergo a military medical commission, and if you were detained in another region where you are not registered, you have the right to undergo the military medical commission in your own region.
“Busification is a crime and an abuse of power. And such a concept as evasion... Well, I don’t know who invented it. Does such a concept even exist legally?” concludes Yekaterina Kotenko.
