Entrepreneurs aim to legalize a controversial unauthorized construction in the heart of Lviv through court proceedings.

The Executive Committee of the Lviv City Council has decided to dismantle an illegal pavilion on Svobody Avenue.

The owners of the restaurant "Yazykata Teshcha" in the center of Lviv are suing the city council, which has decided to demolish the unauthorized pavilion-restaurant. Through the court, Bohdan Dziadyk and Nadiya Tarasevych are attempting to extend the lease agreement for the land plots and cancel the executive committee's decision regarding the dismantling of the pavilion.

This concerns the restaurant located at 16-18 Svobody Avenue in Lviv, situated right behind the Garrison Church and next to school No. 62. In 2012, the establishment was set up with the approval of the Ministry of Culture initially as a pavilion. It was installed along the only preserved fragment of the medieval city defensive wall from the 14th century, as well as the Jesuit Collegium and Church, which are part of the UNESCO heritage. Over the years, the space transitioned from a summer terrace into a full-fledged dining establishment.

At the same time, the owners of the "Knyazhy Kelykh" restaurant did not receive project approval from the Department for the Protection of Historical Environment of the Lviv City Council. In 2014, the Lviv City Council deputies voted to extend the lease of land plots located at 16-18 Svobody Avenue, where the restaurant is situated, for another 10 years to "BiNP LTD."

Currently, the pavilion houses the restaurant "Yazykata Teshcha." In 2024, the lease agreement for the land plots of 0.026 and 0.038 hectares expired for the company "BiNP LTD." Additionally, in August 2024, the executive committee of the Lviv City Council made a decision to dismantle the unlawfully installed temporary structure.

"We requested voluntarily that the owners dismantle this illegal structure. We were not heard. The unfortunate entrepreneur decided to go to court to legitimize this establishment. They also want to prevent the city council from demolishing this summer terrace through a court decision," reported Yevhen Boyko, the managing affairs officer of the Lviv City Council executive committee, on January 7.

The Economic Court is reviewing the claims for the legalization of the pavilion, which is hearing the case regarding the recognition of two lease agreements for 10 years, while the Lviv District Administrative Court is considering the claim to prohibit the dismantling. Both court hearings are scheduled for January 8.

The owners of "BiNP LTD" are Lviv residents Nadiya Tarasevych and Bohdan Dziadyk. This same company constructed an unauthorized building at 2 Shpytalna Street and later legalized the land lease through the court. In December 2023, the Lviv City Council deputies, at the request of Nadiya Tarasevych, allowed the development of a detailed plan in the area of Khmelnytsky, Zhovkivska, and Donetska Streets, which involves the construction of a hotel complex.
