Legislative updates: what's changed for businesses and authorities at the end of December.
How Legislation Changed from December 20, 2024, to December 26, 2024
1. LEGISLATIVE ACTS THAT CAME INTO FORCE
- Document: Law 4113-IX dated December 4, 2024, regarding the stimulation of the digital economy development in Ukraine.
Key Changes: The law specifically provides for:
- for residents of "Diya City" with startup status – the cancellation of the provision regarding the non-application of the preferential personal income tax (PIT) rate of 5% and the minimum single social contribution (SSC) to the incomes of "Diya City" specialists if the number of such individuals in the "Diya City" resident is less than nine. At the same time, a safeguard against abuses is foreseen: if the startup does not meet the criteria by the end of the second year of its residency in "Diya City," there will be a need to pay additional PIT and SSC;
- exemption from taxation of the income received from charitable assistance provided by "Diya City" residents in favor of the Armed Forces of Ukraine;
- cancellation of service acts for gig specialists; etc.
Moreover, for individual entrepreneurs (FOPs) and legal entities on a single tax, changes will take effect from January 1, 2025.
2. Regulatory Acts.
Cabinet of Ministers of Ukraine:
- Document: Resolution dated December 17, 2024, № 1440 (adopted on December 20, 2024) regarding the approval of the Procedure for submitting a notification in Diya about the absence of the possibility of receiving electronic communication services by mobile subscribers.
Essence: The Cabinet allowed complaints about the absence of communication to be submitted in Diya. To submit an informational notification, the subscriber's electronic device must be connected to the internet with the function enabled.
