A Lviv resident won a lawsuit against the municipal authorities, receiving 69,000 UAH for damage caused by a section of the facade falling on his car.

The Lviv Appeals Court has ordered LKP "Varshavske-407" to pay Lviv resident Oleg Smolynets 69,200 UAH for his damaged vehicle. A part of the building facade, maintained by LKP, fell on his Volkswagen.

According to the case materials, on December 16, 2023, Oleg Smolynets parked his Volkswagen Tiguan near building No. 5 on Rappoport Street. That day, a part of the building facade fell on the parked vehicle, causing damage. Oleg Smolynets contacted his insurance company, but they informed him that they could not cover the repair costs as the damage did not fall under insured events.

Subsequently, he reached out to LKP "Varshavske-407," which services the homeowners' association of the building from which the facade fell. After an inspection, the utility workers reported that they found no damage; however, there were emergency balconies, for which the residents were responsible.

Oleg Smolynets disagreed with these findings and provided the court with evidence that the facade was in a critically dangerous condition and posed a threat to pedestrians. Therefore, he filed a lawsuit for LKP to compensate him 58,700 UAH for car repairs and an additional 5,000 UAH for hiring an expert.

In May 2024, the Shevchenkivskyi District Court of Lviv dismissed Oleg Smolynets' claim. However, he appealed the decision. In December, the Lviv Appeals Court granted his claim and ordered LKP "Varshavske-407" to pay the owner of the damaged vehicle a total of 69,200 UAH.
